1. About These Terms

Engold Holdings Pty Ltd (referred to as "we", "us" or "our") provides wholesale trading and distribution services to business clients across Australia. These terms apply to all quotations, orders, supply arrangements and website use unless otherwise agreed in writing.

2. Quotations and Orders

All quotations provided by us are valid for the period stated in the quotation or, where no period is stated, for thirty (30) days from the date of issue. Quotations are subject to product availability and may be withdrawn or revised at any time prior to acceptance. An order is only accepted once we confirm it in writing, at which point a binding agreement is formed on these terms.

3. Pricing and Payment

All prices are quoted in Australian dollars (AUD) and, unless otherwise stated, exclude GST, freight and any applicable duties or handling charges. Payment terms are as stated on our invoice. We reserve the right to require payment in advance or to suspend supply where invoices remain outstanding beyond agreed terms. Late payments may attract interest and reasonable recovery costs.

4. Delivery and Risk

Delivery times provided are estimates only and are not guarantees. Risk in goods passes to you upon delivery to your nominated address or carrier. Title in goods passes upon full payment. Where delivery is delayed due to causes beyond our reasonable control, we are not liable for any resulting loss.

5. Returns

Return arrangements for stock items are as agreed at the time of order. Nothing in this section limits any rights you may have under Australian Consumer Law, including in relation to goods that are faulty or not as described.

6. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement. Where our services are supplied to a "consumer" as defined under that law, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

7. Limitation of Liability

To the fullest extent permitted by law, our liability for any claim arising out of or in connection with our services is limited, at our option, to the resupply of the services or the payment of the cost of resupply. We are not liable for indirect or consequential loss, including loss of profits or business opportunity, except where such liability cannot be excluded by law.

8. Intellectual Property

All content on this website, including text, graphics and logos, is owned by or licensed to Engold Holdings Pty Ltd and may not be reproduced without our prior written consent, other than for personal, non-commercial reference.

9. Privacy

Any personal information collected through this website or in the course of providing services is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

10. Governing Law

These terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

11. Changes to These Terms

We may update these Terms of Service from time to time. The current version will always be published on this page with the date of last revision noted below.
